The Holt County Board of Supervisors met as a Board of Equalization with all members present.  County Assessor Tim Wallinger, County Treasurer Connie Krotter and County Clerk Cathy Pavel were also in attendance.  This meeting publicized pursuant to Section 84-1411 R.R.S. 1943.

Chairman Scholz convened the meeting at 9:30 A.M. with the flag salute.

Motion by Butterfield, 2nd by Metschke, to approve the minutes of the May 16, 2013 meeting as printed.  Voting Aye: Metschke, Tielke, Hahlbeck, Snyder, Butterfield, Boshart and Scholz.  Voting Nay: None.  Motion carried.

Chairman Scholz convened the public hearing to receive public comment on Motor Vehicle Tax Exemption Applications on file for: Atkinson Good Samaritan Society on a 1993 Ford Sport Van; Valley Hope Assoc. on a 2005 Sport Van; West Holt Memorial Hospital on a 2001 Ford Ranger, 2010 Chrysler Van and a 2011 Nissan Sentra.  No one appeared to comment.

Motion by Metschke, 2nd by Butterfield, to adjourn from public hearing at 9:39 A.M. and return to regular session.  Voting Aye: Tielke, Hahlbeck, Snyder, Butterfield, Boshart, Metschke and Tielke.  Voting Nay: None.  Motion carried.

The Board reviewed the overvalued and undervalued parcels of land in Holt County.

Motion by Tielke, 2nd by Metschke, to approve the refund on personal property tax on schedule # 010000347 for 2011 for $897.48 and for schedule #010000836 for 2011 for $2506.83 and 2012 for $1993.18 due to a clerical error.  Voting Aye: Snyder, Butterfield, Boshart, Metschke, Tielke, Hahlbeck and Scholz.  Voting Nay: None.  Motion carried.

Motion by Hahlbeck, 2nd by Boshart, to approve the tax list corrections #13-038 through #13-043 as submitted by the Assessor.  Voting Aye: Butterfield, Boshart, Metschke, Tielke, Hahlbeck, Snyder and Scholz.  Voting Nay: None.  Motion carried.

The Holt County Board of Supervisors met in regular session as per adjournment with all members present.  This meeting publicized pursuant to Section 84-1411 R.R.S. 1943.

Chairman Tielke convened the meeting at 9:54 A.M. and informed the public of the location of the Open Meeting Poster.

Motion by Hahlbeck, 2nd by Boshart, to approve the minutes of the May 16, 2013 meeting as printed.  Voting Aye:  Hahlbeck, Snyder, Butterfield, Boshart, Scholz, Metschke and Tielke.  Voting Nay: None.  Motion carried.

The Board reviewed claims on file.

Barbara Otto and Grace Coleman were present to discuss the Niobrara River Confluence with the Board.

Arnold Hall was present to discuss the Cedar Lawn Cemetery with the Board. 

11:00 A.M. being the time advertised, bids were opened for Cold Milling on the Page Highway.  The following bids were received:

Werner Construction, Inc.         $72,496.98        plus traffic control $8,700.00 

Dustrol, Inc.                             $79,289.54         plus traffic control $6,000.00 

The Board reviewed the bids.  Time was allowed for the one representative present to answer questions from the Board.

Motion by Butterfield, 2nd by Snyder, to approve the zoning application submitted by Kevin & Debra Kramer a tract in the SW ¼ 3-30-15.  Voting Aye: Snyder, Butterfield, Boshart, Scholz, Metschke, Hahlbeck and Tielke.  Voting Nay: None.  Motion carried.

Motion by Metschke, 2nd by Butterfield, to approve the Right of Way permit for waterline submitted by William Tielke in SW ¼ 28-31-13.  Voting Aye: Butterfield, Boshart, Scholz, Metschke, Hahlbeck, Snyder and Tielke.  Voting Nay: None.  Abstain: Tielke.  Motion carried.

Motion by Boshart, 2nd Hahlbeck, to approve the Right of Way permit for telephone cable submitted by Great Plains Communication in Sections 18,7,6,5,4,3,2,1 all in 28-9, 36-28-9 and 36-28-10.  Voting Aye: Boshart, Scholz, Metschke, Hahlbeck, Snyder, Butterfield and Tielke.  Voting Nay: None.  Motion carried.

Motion by Metschke, 2nd by Snyder, to set a bid date for Chambers Northeast and Chambers West culverts on June 17, 2013 at 11:00 A.M.  Voting Aye: Scholz, Metschke, Hahlbeck, Snyder, Butterfield, Boshart and Tielke.  Voting Nay: None.  Motion carried.

RESOLUTION #2013-18

OF THE

HOLT COUNTY BOARD OF SUPERVISORS

            WHEREAS, there has been signed by the County of Holt on the 14th day of October, 2011, and on the State on the 2nd day of November, 2011, an agreement providing for the construction of a Federal Aid Project located one mile south of Hwy 20 on Federal Aid Route 2105.

            WHEREAS, in the above agreement, the County has pledged sufficient funds to finance its share of the cost of the construction of this project identified as ER-2105(3), and          

            WHEREAS, the above mentioned agreement provided that the County would pay costs as set forth in the agreement, and

            WHEREAS, the State and the County received bids for the construction of this project on May 23, 2013 at which time 1 bid was received for the construction of this proposed work, and

            WHEREAS, the following contractor for the items of work listed have been selected as the low bidder to whom the contract should be awarded:

A & R Construction Co., Plainview, NE                        Concrete Pavement: $120,382.73

            NOW THEREFORE, in consideration of the above facts, the Board of Supervisors of the County of Holt, by this resolution, takes the following official action:

1.      If for any reason the Federal Highway Administration rescinds, limits its obligations, or defers payment of the Federal share of the cost of this project, the County hereby agrees to provide the necessary funds to pay for all costs incurred until and in the event such Federal funds are allowed and paid.

2.      The Board hereby concurs in the selection of the above mentioned contractor for the items of work listed, to whom the contract should be awarded.

3.      The Board hereby authorizes the Chairman to sign the contract with the above mentioned contractor for the above mentioned work on behalf of the County.

The foregoing resolution was introduced by Supervisor Metschke who moved its adoption.  Supervisor Boshart seconded the motion.  Voting Aye: Metschke, Hahlbeck, Snyder, Butterfield, Boshart, Scholz and Tielke.  Voting Nay: None.  Motion carried

Chuck Lemp demonstrated railroad ballast mix samples to the Board.

Motion by Snyder, 2nd by Hahlbeck, to accept the low bid from Werner Construction for $72,496.98 plus $8700.00 for traffic control for the Cold Milling on the Page Highway.  Voting Aye: Hahlbeck, Snyder, Butterfield, Boshart, Metschke and Tielke.  Voting Nay: Scholz.  Motion carried.

Road Superintendent Gary Connot presented his Department Activity Report.

Motion by Hahlbeck, 2nd by Boshart, to void check #33162 for $33.10 to Des Moines Stamp Co. due to duplicate payment.  Voting Aye: Snyder, Butterfield, Boshart, Scholz, Metschke, Hahlbeck and Tielke.  Voting Nay: None.  Motion carried.

Motion by Metschke, 2nd by Hahlbeck, to allow the direct deposit payroll and other related claims.  Voting Aye: Butterfield, Boshart, Scholz, Metschke, Hahlbeck, Snyder and Tielke.  Voting Nay: None.  Motion carried.
